The following Privacy Policy describes matters related to the use of the website https://safestack.eu/ (hereinafter referred to as the “Website”).

Our goal is to ensure your sense of security on our Website, which is why your privacy and the protection of your personal data are very important to us. Please carefully read the following summary to learn how our Website operates. We assure you that your data will be processed in a transparent and fair manner, and that we will make every effort to treat it with care and responsibility.

The purpose of this Privacy Policy is to inform you about how we use your personal data, in respect of which we comply with all requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter referred to as “GDPR”).

1. Data Controller

2. Purposes and Legal Bases for Data Processing

Your personal data may be processed by the Controller on the basis of:

a) necessity for the performance of a contract or in order to take steps prior to entering into a contract (Art. 6(1)(b) GDPR), separately for the purpose of:

(i) providing the newsletter service;
(ii) use of training registration forms;
(iii) enabling access to materials related to topics covered on the Website;

b) consent (Art. 6(1)(a) GDPR), for the purpose of conducting marketing of entities cooperating with the Controller;

c) legitimate interest of the Controller (Art. 6(1)(f) GDPR), separately for the purpose of:

(i) marketing the Controller’s own products and services, including for analytical and profiling purposes, where the Controller’s legitimate interest is the direct marketing of its own products and services. The purpose of data profiling is to prepare an offer of Safe Stack products taking into account the preferences of Website users, as well as to provide electronic services in the form of a newsletter;

(ii) use of contact forms made available by the Controller on the Website, where the Controller’s legitimate interest is caring for Website users and responding to questions asked;

(iii) defence against potential claims, where the Controller’s legitimate interest is the pursuit or defence of claims.

3. Transfer of Personal Data

Data may be transferred to entities processing them on our behalf on the basis of agreements concluded with the Controller, but only for the purpose and to the extent necessary for the achievement of the aforementioned purposes, including, among others, entities providing accounting services and IT services or other services ensuring the proper functioning of the Website, whereby such entities process data solely in accordance with the Controller’s instructions.

We transfer your data exclusively to entities located within the European Economic Area and therefore subject to EU data protection regulations, or to those that are bound by an appropriate security standard. The transfer of data to third countries is not currently practised or planned by us.

4. Personal Data Retention Period

We process your personal data only for the period necessary to fulfil the purpose of their storage or for as long as required by law, in particular until the expiry of any potential claims or the expiry of archiving obligations arising from legal provisions, including obligations relating to the retention of accounting documents.

In the case of processing personal data for the purpose of providing the newsletter service, using training registration forms, and enabling access to materials related to topics covered on the Website, your personal data will be processed for the period necessary to provide the service, until you resign from it.

In the event of processing personal data based on your consent, your data will be stored until such consent is withdrawn. You may withdraw your consent at any time, including consent to the processing of data for marketing purposes of entities cooperating with the Controller. The withdrawal of consent to processing will not affect the lawfulness of processing carried out before its withdrawal.

In the case of processing your data on the basis of the Controller’s legitimate interest, the Controller will cease processing the data earlier if you effectively lodge an objection to the processing of data.

5. Your Rights

Right of access to data

You have the right to obtain information regarding the personal data we hold about you, including a copy of such data.

Right to rectification of data

You have the right to request rectification of your personal data that is inaccurate. Taking into account the purposes of processing, you have the right to request the completion of incomplete personal data, including by means of providing a supplementary statement.

Right to erasure of data

You have the right to request the erasure of your personal data held by us in the following cases:

a) your personal data are no longer necessary in relation to the purposes for which they were collected;
b) you have withdrawn consent on which the processing is based and there is no other legal basis for the processing;
c) you have objected to the processing and there are no overriding legitimate grounds for processing, or the objection concerns the processing of data for direct marketing purposes;
d) personal data have been unlawfully processed;
e) personal data must be erased for compliance with a legal obligation under Union or Member State law;
f) personal data have been collected in relation to the offer of information society services referred to in Art. 8(1) GDPR.

Right to data portability

You have the right to receive the personal data concerning you, which you have provided to us, in a structured, commonly used, machine-readable format, where the processing of such data is based on consent or a contract and is carried out by automated means. If you request the transmission of such data to another data controller, this will be done where technically feasible.

Right to restriction of processing

You have the right to request that the processing of your personal data be restricted in the following cases:

a) you contest the accuracy of the personal data – for a period enabling us to verify the accuracy of such data;
b) the processing is unlawful and you oppose the erasure of the personal data, requesting instead the restriction of their use;
c) we no longer need the personal data for the purposes of processing, but they are required by you for the establishment, exercise, or defence of legal claims;
d) you have lodged an objection pursuant to Art. 21(1) GDPR against processing – pending the determination of whether the legitimate grounds on the part of the Controller override the grounds of the objection.

Right to object to processing

If your personal data are processed on the basis of the Controller’s legitimate interest, you have the right to object at any time to the processing, in accordance with Art. 21 GDPR.

Right to withdraw consent

You have the right to withdraw your consent to the processing of personal data at any time. The withdrawal of consent to processing will not affect the lawfulness of processing carried out before its withdrawal.
